MCA Provides Additional Relaxation for Filing Forms

The Ministry of Corporate Affairs (MCA) provided many relaxations in the compliances to be followed by the companies and Limited Liability Partnerships (LLPs) under the Companies Act 2013 and LLP Act 2008. The MCA issued a circular on 3rd May 2021, which provided ease to the companies and LLPs for filing certain forms. On Wednesday, the MCA waived the additional fees and extended the due date provided in the 3rd May 2021 circular for filing the company and LLP forms.

The MCA circular of 3rd May 2021 provided that the due date of the company and LLP forms falling between 1st April 2021 to 31st May 2021 could be filed by 31st July 2021 without any additional fee. Thus, the last date for filing the forms that were due between 1st April 2021 and 31st May 2021 by the companies and LLPs was 31st July 2021. 

On Wednesday, the MCA issued another circular that provided relaxation to the companies and LLPs. The circular issued on Wednesday provided that the forms of the companies and LLPs due for filing from 1st April 2021 till 31st July 2021 can be filed by 31st August 2021 without any additional fees.

The MCA received requests to further extend the last date of 31st July for filing forms due to the hurdles faced by the companies and LLPs during the present pandemic situation prevailing in the country. Thus, the MCA extended the last date for filing forms from 31st July 2021 to 31st August 2021. 

Earlier the MCA also issued another circular allowing companies to conduct Extraordinary General Meetings (EGM) through Video Conferencing (VC) or Other Audio Video Means (OAVM) or transact items through simplified voting or e-Voting facility through registered emails, without the physical presence of the shareholders till 31st December 2021.

The extension granted by the MCA will provide ease to the companies and LLPs to prepare and file the forms with the Registrar of Companies. The companies and LLPs will get time to prepare the forms due from 1st April 2021 till 31st July 2021 and file them without any additional fees.

The companies can pay the regular fees till 31st August 2021 for filing the forms falling due between 1st April 2021 and 31st July 2021. The waiver of additional fees for filing forms and the extension of the last date till 31st August 2021 will help many companies and LLPs comply with the compliance requirements without paying additional fees.
